Town & Country Linen Co., d/b/a Town & Country Living and its related affiliates and subsidiaries (“TNC”) is committed to respecting your privacy and recognizing your need for appropriate protection and management of contact information you share with us. This Privacy Policy applies to the tncliving.com website and its features, as well as any applications, social media sites or online services that post a link to this Privacy Policy, whether accessed via computer, mobile device or otherwise (collectively, the “Site”). The Site is owned or controlled by TNC. This Privacy Policy explains TNC’s information collection practices at the Site, such as the types of information TNC collects regarding visitors to the Site and how we may use, disclose and transfer that information, including without limitation, when you might interact with us over our social media Sites. Please review this Privacy Policy carefully. In addition, please review the Site’s Terms of Use, which governs your use of the Site. By using our Site and/or sharing your contact information and/or Usage Information (as defined below) with us, you are accepting and consenting to the practices described in this Privacy Policy. This Privacy Policy applies only to your use of the Site, and was last updated November 2020. We reserve the right to revise this Privacy Notice at any time. INFORMATION WE COLLECT ABOUT YOU

We may collect, process, and retain information from you and any devices that you may use when you use or interact with our Site, and in other ways described below (collectively “Usage Information”).

Information You Give Us Via Third-Parties:  We currently only store customer names and addresses that we require to drop ship an order that was placed by the customer with one of the third-party platforms that sells our products.  When you place an order for one of our products with a third-party, such as Amazon or Wayfair, such third-party provides us only with your name and address in order for us to ship product directly to you. We may store your name and address as well as information about your prior orders.

Information We May Automatically Collect:  We may receive and store certain types of information when you interact with our Sites. We currently do not use “cookies” or other tracking or tagging technologies.  Our Sites may use “cookies,” tagging and other tracking technologies to help enable you to view and/or shop on our Sites, and to enable us to enhance or personalize your online browsing and shopping experience. This information includes computer and connection information such as statistics on your page views, traffic to and from our Websites, referral URL, your IP address, and device identifiers. This information also may include your browsing history, transaction history, and your web log information. Some of this may be identifiable information when combined with other sources of information collected by us to provide our services. 

Location Information:  When you visit our Site, we may receive information about your location and your mobile device, including a unique identifier for your device. Location information allows us to provide location-based services, such as advertising, search results, and other personalized. 

Information From Social Media:  When you interact with us or our Site on a social media platform, we may collect the personal information that you make available to us on that page, including your account ID or username and other information included in your posts.

Information From Other Sources:  We may supplement the personal information we collect with information from third parties or collected offline, such as information collected by us at events, collected over the phone, and add it to your account information. This information may include, but is not limited to, demographic information that is publicly available and additional contact information. We may also exchange information with third parties for fraud protection and credit risk reduction.

Information From User Content: The Site may provide you the opportunity to submit or post a variety of information, such as photographs, questions, comments, suggestions or other content (collectively, “User Content”). If you choose to share User Content through the Site, the recipient may be able to re-share the content, and that ability will not be subject to your control or TNC’s control. TNC is not responsible for your choice to share User Content or another user’s choice to re-share your User Content.


HOW WE USE YOUR INFORMATION

We use your contact information and the Usage Information to help us personalize and continually improve your experience on the Site, including fulfilling your orders and requests for information and communicating with you.

We may use your contact information, and/or Usage Information collected from one portion of the Site on other portions of the Site, and we may combine information gathered from multiple portions of the Site into a single record. We may also use or combine information that we collect off-line or receive from third-party sources for many reasons, including to enhance, expand, and check the accuracy of our records. Additionally, information collected from a particular browser or device may be used with another computer or device that is linked to the browser or device on which such information was collected.

We may use third party vendors to perform certain services on behalf of the Site, such as providing customer service, fulfilling and processing orders, tracking Site analytics, or performing other administrative services. We may provide these companies with access to your contact information and User Information to carry out the services they are performing for you or for TNC.



INFORMATION SHARING

YOUR PERSONAL INFORMATION WILL NOT BE SOLD. Nor will your Personal Information be licensed or disclosed to unaffiliated third-parties, except in connection with the sale, transfer, merger, consolidation or other transaction involving all or part of our company or as may be permitted under applicable law.

We use third-parties in order to fulfill your transactions.  These third-parties may have access to your Personal Information in order to process your payment card information, and to provide you with coupons and product promotions. 

We may disclose your personal information to our subsidiaries and affiliates to fulfill the purpose for which you provide it, for example, to provide you with a requested communication. Although the Site currently does not display ads from third parties, TNC may work with network advertisers, ad agencies, third party traffic measurement services, and other vendors to provide us with information regarding traffic on the Site, to serve our advertisements on other web sites, within third party applications, and across the Internet, and to provide us with information regarding the use of the Site and the effectiveness of our advertisements.

In addition to the above, we may share the information collected from you, as described above, with our third party partners to enable us to analyze and use such information to provide you with our products and services, and in the manner set forth in this Privacy Notice. We may share your information with third-parties who assist us with our outreach and engagement communications to make you aware of certain of our products and services. We also allow our website hosting partners and other parties who assist us in operating our website, conducting our business, or serving our users, to access and process your information so long as those parties agree to keep this information confidential. We do not sell your information to third parties for marketing purposes, and we restrict such third parties’ usage of your information consistent with this Privacy Policy.

In addition to the above, we may be required to disclose your information to (i) comply with laws or to respond to lawful requests and legal process (including to respond to requests from public or government authorities, including public or government authorities outside your country of residence), (ii) to investigate, prevent, or take action regarding illegal or suspected illegal activities, (iii) to protect our rights and property, and others, to enforce our agreements, and this Privacy Policy and the Terms of Use, including to protect the security or integrity of the Site or our information systems, (iv) in an emergency to protect person or property, (v) as may be needed on a confidential basis to support a corporate transaction (including a merger, acquisition, divestiture, financing, or sale of assets or lines of business), or (vi) on an aggregated basis for any purpose in which your specific personal information is blinded, masked or otherwise not identifiable. We may also exchange information with third parties for fraud protection and credit risk reduction.

Opting Out Of Marketing; Updating Information

We want to communicate with you only if you want to hear from us. If you prefer not to receive direct marketing from us or from our partners, or if you would like to opt out of our rental or exchange of your information with other marketers, please let us know. You can easily remove yourself from our direct marketing efforts by calling us at 1-877-201-0226 or sending us an email at consumerprivacy@tncliving.com. Please be sure to include your full name, email address, mailing address and specifically what information you do not want to receive. 

Please note that any requests to remove or update your contact information may take up to five days for your email request and 6–8 weeks to process your postal mail request at the address listed on our website.



THIRD PARTY CONTENT

Certain content on the Site may be hosted and served by third parties and the Site, and the Site may contain links to third party web sites that TNC does not control. This includes links from advertisers, sponsors, and partners that may use our logo(s) as part of a co-branding agreement. In addition, TNC content may be included on web pages and web sites that are not associated with TNC and over which we have no control. 

These third parties may collect Contact Information, User Content and/or Usage Information through the use of their own cookies and web beacons, independently collect data or solicit Personal Information, and may have the ability to track your use of their sites and services. TNC is not responsible for the privacy practices employed by any third party.  This Privacy Policy does not apply to the information collected or obtained by any third party, including through any application or content that may link to or be accessible from or on the Sites.



INFORMATION SECURITY

TNC takes commercially reasonable security measures to protect the Personal Information submitted to us, both during transmission and once we receive it. These measures may vary based on the sensitivity of your information.   

However, no data transmission over the Internet, wireless transmission or electronic storage of information can be guaranteed to be 100% secure. Please note that we cannot ensure, guarantee or warrant the security of any information we collect or that such information may not be accessed, disclosed, altered, destroyed by breach of any of our physical, technical or managerial safeguards.   You can help protect the privacy of your own information by using encryption and other techniques to prevent unauthorized interception of your personal information.  You are responsible for the security of your information that you transmit to us or view, download, or otherwise access when using unencrypted, public or otherwise unsecured networks.  ADDITIONALLY, YOU USE OUR SITE AND PROVIDE US WITH YOUR INFORMATION AT YOUR OWN RISK.

Protecting Your Information

We want you to feel confident about using our Site, and we are committed to protecting the personal information we collect, but you acknowledge that no method of safeguarding is one hundred percent (100%) secure. We limit access to personal information about you to individuals who reasonably need access to it, to provide products or services to you or in order to do their jobs. However, where we ask you to choose a password in order to access certain parts of our Site, you are responsible for selecting a secure password and keeping that password confidential. You should choose a password which you do not use on any other site, and you should not share it with anyone else. If you choose to access our Site and provide us with any personal information, then this is at your own risk.

Protecting Children

We do not knowingly collect personal information from children under 16 If you are a parent or guardian and you are aware that any of your children has provided us with personal information without your consent, please contact us and we will take steps to remove that information from our servers.



California Consumers

The California Consumer Privacy Act of 2018 (“CCPA”) and other California privacy laws provides California residents (i.e., consumers) with specific rights regarding personal information. This section of the Privacy Policy describes those CCPA rights and how to exercise those rights. This section does not apply to publicly available information.

 

Access to Specific Information and Data Portability Rights

California residents have the right to request that we disclose certain information to you about our collection and use of your personal information over the past twelve (12) months. Once we receive and confirm a verifiable consumer request from you, we will disclose to you, to the extent permitted by law: 

  • The categories of personal information we collected about you.

  • The categories of sources for your personal information we collected about you.

  • Our business or commercial purpose for collecting your personal information.

  • The categories of third parties with whom we share your personal information.

  • If we disclosed your personal information for a business purpose, the personal information categories that each category of recipient obtained.

 

You shall have the right to request that the information described above be provided to you in a portable and readily useable format, to the extent technically feasible (“data portability”).

We do not sell your personal information.

 

Deletion Request Rights

You have the right to request that we delete certain of your personal information that we collected from and/or related to you and retained, subject to certain exceptions. 

To the extent that we can delete your personal information, once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information, unless an exception applies.

We may deny your deletion request if retaining the information is necessary for us or our service providers to:

  • Complete the transaction for which we collected your personal information, provide a good or service that you requested, or take actions reasonably anticipated within the context of our ongoing business relationship with you.

  • Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity, or prosecute those responsible for such activities.

  • Debug products to identify and repair errors that impair existing intended functionality.

  • Exercise free speech, ensure the right of another consumer to exercise their free speech rights, or exercise another right provided for by law.

  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 seq.).

  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information's deletion may likely render impossible or seriously impair the research's achievement, if you previously provided informed consent.

  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.

  • Comply with a legal obligation.

  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.

 

Exercising Your Access, Data Portability, and Deletion Rights

To exercise the access, data portability, and deletion rights described above, please submit a verifiable consumer request to us by either:      

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative.

  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with your personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.  Making a verifiable consumer request does not require you to create an account with us.  We will only use personal information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request. Any disclosures provided pursuant to the CCPA will only cover the 12-month period preceding the receipt of the verifiable consumer request. 

We will respond to a verifiable consumer request within 45 days of its receipt, or notify you that we require more time to respond and the reason for the extended response time. We will deliver our written response by mail or electronically, at your option.   

To the extent that your verifiable consumer request is excessive, repetitive, or manifestly unfounded, we may charge a reasonable fee to respond to such request. 

We will not discriminate against you for exercising any of your CCPA rights. Unless permitted by the CCPA, we will not 

  • Deny you goods or services.

  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.

  • Provide you a different level or quality of goods or services.

  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Policy Changes

If we decide to change our privacy policy in whole or in part, we will inform you by posting a notice on our web sites, as applicable. Those changes will go into effect on the effective date posted in the notice and at the end of the revised Privacy Policy. The new policy will apply to all current and past users of our web sites and will replace any prior policies that are inconsistent. Your continued use of our web sites or other services constitutes your acceptance of the practices described in the revised Privacy Policy.

International Users

If you use our Websites outside of the United States, you understand and consent to the transfer of your personal information to, and the collection, processing, and storage of your personal information in, the United States and elsewhere. The laws in the U.S. and these countries regarding personal information may be different than the laws of your state or country.

If you are an international user, you may have the right to access and/or obtain a copy of your Personal Information, correct inaccuracies in your Personal Information, request the erasure of your Personal Information and restrict the processing of your Personal Information.
